Statement on the quarry of El Zacacho (Arimesa) (08/10/2016)

The Aggregates merchant Mediterranean SA, develops an activity quarry in the area of ​​El Zacacho, in the municipality of Santomera, with municipal license (1974, the City of Murcia, it still had not segregated this the municipality of Santomera ) for the activity of "crushing and aggregates," but not for quarry activity ( 'extraction').

This statement does not make this City, but the Administrative Chamber of the TSJ of Murcia in its judgment 373/2008 of 30 April.

In short, Arimesa SA carries 42 years doing an activity without a municipal license.

Following the judgment, the City of Santomera then -gobernando by the Popular Party adopted on 24 July 2009 an agreement of Local Government in which, based on the absence of municipal license of activity, decreeing the closing thereof.

This agreement was appealed by the company Arimesa, appeal was dismissed by the judgment of 4 November 2013 the Court of Administrative Litigation No. 4 in Murcia, subsequently confirmed by the Board of Administrative Litigation of the Supreme Court of Murcia in its judgment 25 / 2015 of 29 January.

This last sentence is worth noting the following:

"There is no doubt that the attitude of the applicant to keep unauthorized and not ask for opening license when he was awarded in 2008 the authorization to exploit the resources of Section C, makes fully consistent with the law sanctioning resolution activity that the cessation of activity is agreed "

(...)

"The plaintiff needed to obtain a new license of municipal activity with law enforcement force at the time of making application in obtaining appropriate assessment mandatory environmental impact."

In November 2015, with the unanimous favorable vote of the Popular Party, Citizens and Alternative for Santomera PSOE, was approved by the Plenum initiate the procedure to enforce the judgment 25/2015 of 29 January.

Launched this procedure, they have held several meetings with representatives of the company and workers of the same to try to reach agreements that will cushion or minimize compliance with the sentence.

Since this Plenum was adopted, the company has been demanding this different Ayuntamiento documentation in order to get the only environmental authorization -dependent autonomous region and thus to legalize exploitation.

Today, the City Council has issued all required documentation for both the commercial as the competent body to the environment.

Specifically, they have been issued the certificate of compatibility planning and environmental reports on municipal powers;

with this information sent to the Autonomous Community, the City Council has done everything that is in their powers.

It is therefore up to the competent environmental body, and has all the documentation for it, granting or not the only environmental authorization that allows the City Council issued the relevant license for legalization of the quarry.

Without the favorable response by the environmental agency, part of the autonomous region, and based on all developed above, this council must abide by and comply with the ruling 25/2015 of 29 January, which textually states the following: "Final Closing and total sitas facilities and machinery in the place of Zacacho and the suspension of mining any kind of industrial activity or any other sequence in the same until no corresponding activity license is obtained. "
