In relation to the court ruling that admits the complaint filed by the commercial Arimesa against the mayor of Santomera, Inmaculada Sánchez Roca, the councilor for Urbanism, Joaquín Rubio, and the municipal architect for an alleged crime of administrative trespass, the first two They wish to clarify that:

The complaint comes from a company, Arimesa, which has not stopped harassing us and insulting us since we are a government team.

It is a revenge that seeks to undermine our honor by having executed the final judgment of the Superior Court of Justice, which ordered the closure of the facilities of the quarry that this merchant operates in the area of ​​Zacacho.

This quarrel, biased and political, is another form of persecution more to which the company has subjected us for three years.

We are investigated for putting us in front of the most radical economic corruption, but we will continue to defend the environment and the heritage of our municipality, regardless of who may be.

The Government team of Santomera has proceeded at all times in accordance with what is established by law and according to the criteria of the municipal technicians.

In this regard, it should be noted that the City Council of Santomera issued in 2016 the urban compatibility certificate of the quarry, but this was rejected by the Directorate General of Housing and Land Planning, which did not accept the precautions related to the lack of mandatory assessments. environmental

We must also remember that Arimesa has been requesting that compatibility card since 2010, without the two previous government teams, from the PP, taking any steps to resolve it;

his procedure, therefore, should be judged under the same conditions.

We demand that not only be investigated our management, which is the one that has taken steps to solve the situation, but also the inaction of the two previous governments of the Popular Party, which have also had to do with this file.

In a few dates we will present a complaint for environmental crimes against the commercial company Arimesa, which has been carrying out a contaminating activity for more than four decades without possessing the necessary license.

It is quite unfair that exemplary government management is marred by an irregular situation that has lasted for 44 years, which is more age than both of us have.

In addition, we will join the criminal complaint filed by Ecologists in Action against the Ministry of Development and Infrastructure and its previous owner Francisco Bernabé, for a crime of prevarication.

We are ready to clarify everything, we are very calm because our actions have always been protected by technical and legal criteria.

BACKGROUND

The company Áridos del Mediterráneo SA develops a quarry activity in the area of ​​El Zacacho, in the municipality of Santomera, with a municipal license (from 1974, the City of Murcia, because the municipality of Santomera had not yet been segregated). for the activity of "crushing and classification of aggregates", but not for the activity of quarry ("extraction").

This statement is not made by this City Council, but by the Contentious Administrative Chamber of the Supreme Court of Murcia in its judgment 373/2008, of 30 April.

In short, Arimesa SA has been doing an activity for 44 years without a municipal license.

Following the aforementioned ruling, the City Council of Santomera, then ruling by the Popular Party, adopted on July 24, 2009 a Local Government Board agreement in which, based on the absence of a municipal license for the activity, it decreed the closure of the the same.

This agreement was appealed by the commercial Arimesa, appeal that was dismissed by the judgment of November 4, 2013 of the Court of Contentious Administrative n ° 4 of Murcia, later confirmed by the Chamber of Contentious Administrative of the Supreme Court of Murcia in its judgment 25/2015, of January 29.

From this last sentence it is worth highlighting the following:

"There is no doubt that the complainant's attitude in maintaining an unauthorized activity and not requesting an opening license when he was granted authorization in 2008 to exploit the resources of Section C, makes the sanctioning resolution fully in line with the law. the cessation of the activity is agreed "

"the plaintiff needed to obtain a new license of municipal activity with application of the legislation in force at the time of making the request, obtaining in its case the mandatory environmental impact assessment."

And, he added, textually, the following order: "Final and total closure of the facilities and machinery located in the Zacacho site and the suspension of any type of industrial mining activity or any other existing order in it until it is obtained the corresponding activity license ".

In parallel, the company is in the process of obtaining the urban compatibility certificate that allows them to obtain a new activity license and legalize exploitation.

The City Council issued that card in 2016, but warning of various irregularities, translated into caution, referring to the lack of mandatory environmental assessments that should be carried out by the Autonomous Community in certain sectors of the operation.

The General Directorate of Housing and Territory Planning, however, sent a request obliging the City Council to issue this card without any reservations.

In response to this, the government team commissioned a report to the municipal legal services to indicate the steps to follow.

Based on this report and the requirement of the Autonomous Community, the municipal architect drafted a technical-urban document that was sent for information to the Directorate General of Land Planning, Architecture and Housing, as claimed by the regional body , as well as the municipal architect himself to be able to issue the card without the reservations initially raised.

The Autonomous Community nevertheless contradicted its previous order and refused to fill out that document last March;

Since then, the City Council's technical and legal services have been working on this new scenario.
